Effective Date: October 21, 2026

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Explore Canada Tourism Group Inc. (“Company,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, syxveran.site, and any related services, content, bookings, communications, and travel-related offerings provided by Explore Canada Tourism Group Inc. (collectively, the “Services”).

By accessing, browsing, using, or making a booking through our website or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by any additional policies referenced herein. If you do not agree with these Terms, you must not use the Services.

If you use the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and “you” will include that entity.

2. Scope of Services

Explore Canada Tourism Group Inc. provides travel-related services, which may include, without limitation:

  • Travel planning and itinerary assistance;
  • Tour coordination and booking support;
  • Arrangement of transportation, accommodations, and related travel services;
  • Customer service and travel information;
  • Other tourism and travel facilitation services offered from time to time.

We act as a travel service provider and/or intermediary as applicable. Certain components of your travel experience may be provided by third parties, including airlines, hotels, tour operators, transportation providers, and activity vendors (“Third-Party Providers”). Those Third-Party Providers may have their own terms, conditions, policies, and restrictions, which you agree to comply with.

We do not guarantee the availability, pricing, suitability, safety, timing, or performance of services offered by Third-Party Providers. Any estimate, itinerary, or quotation is subject to availability and confirmation.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, current, and complete information at all times;
  • Review all booking details carefully before confirming any reservation;
  • Comply with all applicable laws, regulations, and travel requirements, including passport, visa, customs, health, vaccination, and insurance requirements;
  • Ensure that all travelers in your party meet the eligibility requirements for the selected travel services;
  • Arrive on time for scheduled departures, check-ins, and activities;
  • Use the Services only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation of the Services;
  • Promptly notify us of any errors, discrepancies, or changes to your travel plans.

You are solely responsible for verifying travel documentation and entry requirements for all destinations and transit points. We do not provide legal, immigration, customs, or medical advice.

You must not:

  • Use the Services for fraudulent or deceptive purposes;
  • Interfere with the security or functionality of our website;
  • Attempt to access systems or data without authorization;
  • Submit false, misleading, or incomplete information;
  • Resell, copy, or exploit the Services without our prior written consent.

4. Payment Terms and Conditions

Unless otherwise stated, all prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes, fees, surcharges, and third-party charges. Prices may change without notice until a booking is confirmed and paid in full, where applicable.

Payment methods accepted, payment deadlines, deposit requirements, and installment terms may vary depending on the service, supplier, and booking conditions. By submitting payment information, you represent that you are authorized to use the selected payment method and that the information provided is accurate.

You authorize us and our payment processors to charge your selected payment method for all applicable amounts, including deposits, balances, cancellation fees, penalties, and other charges expressly disclosed at the time of booking or later incurred under these Terms.

If a payment is declined, reversed, charged back, or otherwise not received, we may cancel or suspend the associated booking or Services without liability, subject to applicable law. You are responsible for any fees charged by your bank or payment provider.

We may require identity verification or additional information before processing or confirming a booking. We reserve the right to refuse or cancel any transaction suspected of fraud, abuse, or unauthorized activity.

5. Cancellation and Refund Policy

Cancellation and refund eligibility depend on the specific service, booking type, supplier terms, and timing of the cancellation request. Some bookings may be non-refundable, partially refundable, or subject to administrative fees and supplier-imposed penalties.

Unless otherwise specified in writing:

  • Deposits may be non-refundable;
  • Refunds, where available, may exclude service fees, processing fees, and third-party penalties;
  • Late cancellations or no-shows may result in loss of the full booking amount;
  • Changes to dates, names, routes, or services may be treated as cancellations and rebookings and may incur additional charges.

To request a cancellation or change, you must contact us promptly using the contact information below. Any refund, if approved, will be processed to the original payment method where practicable and within a reasonable time. Processing times may vary depending on your bank, card issuer, or payment provider.

If a Third-Party Provider cancels or materially changes a service, any remedy will be governed by that provider’s terms and applicable law. We will reasonably assist you where appropriate, but we are not responsible for Third-Party Provider decisions, delays, or failures.

Travel disruption caused by weather, strikes, mechanical issues, government actions, public health measures, or other events beyond our control may affect cancellation rights and refund availability.

6. Liability Limitations

To the maximum extent permitted by applicable law, Explore Canada Tourism Group Inc., its directors, officers, employees, agents, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, loss of opportunity, or loss of data, arising out of or related to your use of the Services.

We are not liable for:

  • Acts, omissions, errors, or negligence of Third-Party Providers;
  • Delays, cancellations, schedule changes, overbookings, or service failures by carriers or suppliers;
  • Inaccurate information supplied by third parties or by you;
  • Travel disruptions caused by weather, natural disasters, pandemics, civil unrest, terrorism, government orders, labor disputes, or other force majeure events;
  • Loss, theft, damage, or delay of baggage or personal property;
  • Your failure to obtain required documents, insurance, or vaccinations;
  • Your failure to comply with applicable laws, supplier rules, or safety instructions.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services shall not exceed the amount you paid to Explore Canada Tourism Group Inc. for the specific service giving rise to the claim, or CAD $100 if no payment was made, whichever is less, except where liability cannot lawfully be limited.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Canadian law, including liability for gross negligence, wilful misconduct, or statutory rights that cannot be waived.

7. Intellectual Property Rights

All content on the website and in the Services, including text, graphics, logos, images, design elements, software, compilations, and trademarks, is owned by or licensed to Explore Canada Tourism Group Inc. and is protected by Canadian and international intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the website and content solely for personal, non-commercial travel-related purposes in accordance with these Terms. All third-party trademarks, logos, and materials remain the property of their respective owners and are used for identification or informational purposes only.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including applicable federal and provincial privacy legislation. By using the Services, you consent to our collection, use, and disclosure of your personal information as necessary to provide the Services, process bookings, communicate with you, comply with legal obligations, and improve our operations.

Personal information may be shared with Third-Party Providers, payment processors, service partners, regulatory authorities, or other parties as necessary to fulfill your booking or as otherwise required or permitted by law.

You acknowledge that travel services often require the transfer of personal information across jurisdictions, including to suppliers located outside Canada. Such information may be subject to the laws of those jurisdictions.

You are responsible for ensuring that any personal information you provide about other travelers has been collected with proper authority and consent.

For privacy-related inquiries, contact us using the details in Section 12. Additional privacy practices may be described in a separate privacy policy, if available, which is incorporated by reference where applicable.

9. Force Majeure

We shall not be liable for any delay, failure to perform, or inability to provide the Services due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, fires, floods, earthquakes, storms, and extreme weather;
  • War, terrorism, civil unrest, riots, or government restrictions;
  • Public health emergencies, epidemics, pandemics, quarantine orders, or border closures;
  • Labor disputes, strikes, transportation interruptions, or utility failures;
  • Cyberattacks, telecommunications failures, or internet outages;
  • Actions or omissions of Third-Party Providers or authorities.

If a force majeure event occurs, we may suspend, modify, or cancel affected services without liability to the extent permitted by law. Any refund, rescheduling, or credit, if any, will be determined in accordance with supplier policies and applicable law.

10. Changes to Terms

We may revise these Terms from time to time to reflect changes in our operations, legal requirements, or service offerings. When we make material changes, we will update the “Effective Date” and may provide additional notice where reasonably practicable.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or related to them, the website, or the Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any applicable consumer protection laws or mandatory legal rights, you agree that the courts located in Vancouver, British Columbia shall have exclusive jurisdiction and venue over any dispute, claim, or proceeding arising from or relating to these Terms or the Services.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that best reflects the original intent of the parties.
